2. Applicability

2.1 These Terms apply to every offer on this website and to every contract concluded between us and you (the customer).

2.2 We make these Terms available before you place your order, so you can save or print them.

2.3 If any provision is or becomes invalid, the remaining provisions stay in force and we will replace the invalid provision with a valid one that matches its purpose as closely as possible.

3. Products and custom printing

3.1 We sell paper chip cones and food bags, cone holders, forks, sauce cups and related products, including custom printed items.

3.2 Product images and descriptions are as accurate as possible but are indicative. Minor differences in colour, size or material do not entitle you to cancellation, except as required by law.

3.3 Custom printed products are made to your specifications. You are responsible for the correctness of the artwork, text, quantities and specifications you approve. The statutory right of withdrawal or return generally does not apply to bespoke or personalised goods made to your specification (see section 6). Please check your proof carefully before approval.

4. Prices

4.1 Prices are shown in pounds sterling (GBP), inclusive of UK VAT.

4.2 For orders imported into the UK from outside the UK, please note the UK low value consignment rules: for consignments not exceeding GBP 135, UK VAT is charged at the point of sale; for consignments above GBP 135, import VAT and any customs duty may be payable by you on import.

4.3 Shipping costs, taxes and any duties are shown before you confirm your order.

5. Orders and formation of contract

5.1 A contract is formed when we confirm your order by email.

5.2 We may refuse an order or set conditions, for example in case of stock issues, suspected fraud, or artwork that infringes third party rights.

6. Right of withdrawal / cancellation (UK consumers)

Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving the goods, without giving a reason.

To cancel, inform us at Cocobe B.V., Dr. Schaepmanlaan 27, 4836 AR Breda, the Netherlands, [email protected], by a clear statement (for example a letter or email) of your decision to cancel, within that period. You may use the model cancellation form below, but this is not obligatory.

You then have 14 days to return the goods to us from the date you tell us you wish to cancel. If you cancel this contract, we will reimburse all payments received from you, including the cost of standard delivery (excluding any extra cost if you chose a delivery method other than our cheapest standard delivery option), without undue delay and in any event within 14 days of the day on which we receive the goods back, or, if earlier, the day you provide evidence that you have sent the goods back.

Exception: bespoke or personalised (custom printed) goods cannot be cancelled under this right.

6.1 During the withdrawal period you must handle the goods and packaging with care and only to the extent needed to establish the nature, characteristics and functioning of the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

7. Business customers (horeca and trade)

7.1 The consumer right of withdrawal in section 6 does not apply to purchases by businesses.

7.2 For business orders, returns are only accepted by prior written agreement. Custom printed orders are non returnable.

8. Returns policy (voluntary)

8.1 If you are entitled to return an item, or we accept a voluntary return, contact us first at [email protected] for a return authorisation and the return address. Our current return address is Veldsteen 24, 4815 PK Breda, the Netherlands.

8.2 Unless the goods are faulty or not as described, you pay the cost of return shipping.

8.3 We refund to your original payment method within 14 days of receiving the returned goods.

9. Faulty or incorrect goods

Goods must match their description, be of satisfactory quality and fit for purpose under the Consumer Rights Act 2015. If goods are faulty you may be entitled to a repair, replacement or refund.

9.1 Please report any damage, shortage or defect within 7 days of delivery, with photos where possible. This does not affect your statutory rights.

9.2 UK consumers: in addition to your other rights, under the Consumer Rights Act 2015 you have a short-term right to reject faulty goods within 30 days of delivery for a full refund.

10. Payment

10.1 Accepted payment methods are shown at checkout, including iDEAL, Bancontact, PayPal and credit card.

10.2 Payment is due at the time of order unless otherwise agreed in writing.

11. Delivery

11.1 We aim to dispatch orders within 2 business days of payment (custom print orders may take longer, see the product page).

11.2 Delivery times are indicative. We are not liable for delays caused by carriers or customs.

11.3 Risk of loss passes to you on delivery (for consumers) or on dispatch for business customers.

11.4 For international orders, you are the importer of record and responsible for any import duties or taxes unless stated otherwise at checkout.

12. Liability

12.1 Nothing in these Terms limits liability that cannot be limited by law (for example death or personal injury caused by our negligence, or fraud).

12.2 Subject to 12.1, for business customers our total liability is limited to the value of your order. This cap does not apply to consumers; your statutory rights and remedies as a consumer remain unaffected.

12.3 We are not liable for indirect or consequential loss.

13. Intellectual property (custom artwork)

13.1 You warrant that any artwork, logo or text you supply for custom printing does not infringe any third party’s rights and you indemnify us against claims arising from it.

13.2 You retain rights in your own artwork. We retain rights in our own designs, website and content.

14. Complaints

14.1 Complaints can be sent to [email protected]. We respond within 14 days.

14.2 We are not obliged, and do not currently agree, to participate in a consumer ADR (alternative dispute resolution) scheme. This does not affect your right to bring a claim before the competent court or to contact the relevant regulator (the Citizens Advice consumer service or Trading Standards).

15. Governing law and jurisdiction

• UK consumers: these Terms are governed by Dutch law. As a consumer, you also benefit from the mandatory consumer protection provisions of the law of your part of the United Kingdom of residence, which cannot be excluded by agreement.
• Business customers: Dutch law, disputes before the competent court in Breda, the Netherlands.
